The petitioner apprehends his arrest in Singhwara P.S. Case No. 128 of 2021, registered for the offences punishable under Sections 363, 366A, 323, 504, 380, 506/34 of the Indian Penal Code.

Prosecution case in brief is that petitioner kidnapped the daughter of informant. It is alleged that when informant went at the house of petitioner to enquire about her daughter, the accused persons abused her in filthy language. It is submitted that petitioner has been falsely implicated in this case. The victim girl in her statement under Section 164 Cr.P.C stated that she was having love affair with the petitioner and out of her own sweet will she left her house

Patna High Court CR. MISC. No.67613 of 2021(3) dt.08-08-2022 2/2 went along with petitioner and also solemnized marriage. The court below assessed her age to be 18 years.

In view of the statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Darbhanga/concerned court in connection with Singhwara P.S. Case No. 128 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
