JUSTICE BIBEK CHAUDHURI ORAL ORDER 19-06-2025 This is an application under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, 2015 filed by the father of the juvenile as his natural guardian praying for bail.

2. The juvenile alongwith others were implicated in Baisi P.S. Case No.391 of 2023 under Sections 25(1-b)a, 26, 35 of the Arms Act was incorporated against the juvenile and other accused persons.

3. It is submitted by the learned Advocate on behalf of the petitioner that the juvenile was arrested on the basis of a confessional statement recorded under Section 164 of the Cr.P.C. of one Mohd. Sahil Anjum. The said Mohd. Sahil Anjum was released on bail in Cr. Revision No.475 of 2023 by a

Patna High Court CR. REV. No.690 of 2024(2) dt.19-06-2025 2/3 Coordinate Bench of this Court vide order dated 23.09.2024. Therefore, the petitioner should also be release on bail.

4. It appears from the record that a fire arms and live cartridges were recovered from the house and possession of the juvenile. The case is under investigation to establish as to whether the seized fire arm was used for committing murder of the victim. The juvenile is more than 16 years of age on the date of commission of offence.

5. I have carefully perused the entire materials on record as well as the orders passed by the Juvenile Justice Board and also by the Court of Appeal.

6. The learned APP for the State who has raised objection for prayer of bail of the juvenile.

7. Juvenile was arrested in connection with Bahadurpur P.S. Case No.354 of 2023 under Sections 363, 364 and Baisi P.S. Case No.391 of 2023 under Section 25(1-b)a, 26, 35 of the Arms Act.

8. Mohd. Sahil Anjum was released on bail in connection with Baisi P.S. Case No.391 of 2023 so far as Bahadurpur P.S. Case No.354 of 2023 no document is forthcoming to ascertained as to whether the said Mohd. Sahil Anjum was granted bail or not. The order for rejection of bail of

Patna High Court CR. REV. No.690 of 2024(2) dt.19-06-2025 3/3 the juvenile passed by the Juvenile Justice Board shows that the juvenile himself made a confessional statement under Section 164 of the Cr.P.C. in Bahadurpur P.S. Case No.354 of 2023 implicating himself in committing the offence.

9. Considering such aspect of the matter, this Court concurs with the view of Juvenile Justice Board as well as the Appellate Court, the prayer for bail of the juvenile is thus, rejected.
