Petitioner apprehends his arrest in connection with Pratapganj P. S. Case No. 15/2015 registered for offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
The prosecution case is that on the basis of T.E.T certificate the petitioner tried to get appointment as Panchayat teacher, which was found forged and fabricated during the course of enquiry by the District Education Officer, and B.D.O., Pratapganj.
It has been submitted by the learned counsel for the petitioner that the petitioner has not yet secured any job on the basis of the alleged false certificates and in other cases, which has been mentioned in para-3 of this application, the petitioner has
Patna High Court Cr.Misc. No.17889 of 2016 (2) dt.05-05-2016 2/2 already been granted the privilege of anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. Nos. 5888 of 2016 dated 22.02.2016 and Cr. Misc. No. 5107 of 2016 dated 29.03.2016 on similar allegations.
However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report and has been using as forged T.E.T. certificate for securing appointment in other places also hence, opposes the prayer for bail. Be that as it may, since the petitioner has not yet secured a job on the basis of such forged certificate let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of like amount each to the satisfaction of learned S.D.J.M., Birpur in connection with Pratapganj P.S.Case No. 15/2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
