JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and seven F.I.R named accused as well as thirty unknown students are said to have assaulted the informant and two others by means of lethal weapons such as hockey, rod etc. Out of three injured, the condition of one injured started deteriorating and he was shifted to a private hospital from P.M.C.H.

Contention on behalf of the petitioner is that petitioner is in jail custody since 25.02.2016 and he does not have any criminal antecedent. Moreover, petitioner is a student and no specific overt act has been attributed against him. Furthermore, it is submitted that there is nothing on the record to show that the release of the petitioner will hamper the trial and tamper with the

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Pirbahore P.S.Case No. 59 of 2016.
