The petitioner seeks pre-arrest bail in connection with Nokha P.S.Case No. 195 of 2016 registered under Section 409 of the Indian Penal Code.

It is contended by the learned counsel for the petitioner that the petitioner took charge of Gram Panchayat, Ghosia, Sotwan and Uttri Baraon in March, 2014 and he has got no concern with the folder file of the teachers appointed prior to that.

Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. He submitted that the allegation against the petitioner is that he did not hand over the folder file, provisional and final merit list,

Patna High Court Cr.Misc. No.21670 of 2017 (2) dt.06-07-2017 2/2 registers etc. to the Block Education Officer in respect of appointment of Panchayat Teachers.

Regard being had to the nature of accusation as also the fact that the petitioner is in Government service and has got roots in the society and is not likely to flee from justice, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Sasaram in connection with Nokha P.S.Case No. 195 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of his arrest or surrender before the court below within six weeks from today.
