JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Petitioner seeks bail in anticipation of her arrest in connection with Kadam Kuan P.S. Case No. 777 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
Police found a Scooty without number in abandoned condition and dickey was open and from the dickey of scooty four bottles of liquor were recovered and petitioner happens to be owner of the scooty.
Submission of learned counsel for the petitioner is that FIR itself shows that dickey was in open condition and she was not present there and husband of petitioner has been granted bail by learned Special Judge.
Heard learned APP also.
In view of above facts and circumstances, let
Patna High Court CR. MISC. No.58816 of 2019(2) dt.18-09-2019 2/2 petitioner surrender in the court below within a period of two weeks from the receipt of this order and on surrender she shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Kadam Kuan P.S. Case No. 777 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
