Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Gwalpara P.S. Case No. 170 of 2022, lodged under Sections 302/34 of the Indian Penal Code read with Section 27 of Arms Act.

As per prosecution case, the informant has disclosed that her husband who was the PACS Chairman and B.J.P. leader has been killed by unknown criminals, with this allegation the F.I.R. has been lodged.

Learned counsel for the petitioner submits that F.I.R. has been filed against unknown but in the re-statement, the

No.56596 of 2022(2) dt.24-12-2022 2/3 informant has disclosed in total 11 names who are accused in this case including the petitioner and one Binod Singh who lost mukhiya election in the year 2021 and during election of PACS Chairman in the year 2015 against the husband of informant. He further submits that said Binod Singh whose name has figured in this case by the re-statement has been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 22.11.2022 passed in Cr. Misc. No. 57317 of 2022. Learned counsel submits that the present petitioner is not seeking anticipatory, rather he is seeking regular bail, he is in custody since 03.08.2022 and charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Udaykishanganj, Madhepura in connection with Gwalpara P.S. Case No. 170 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
