JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Amour P.S. Case No. 214 of 2015, registered under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. The accusation is that, on 26.11.2015, Dilkhush, sonin-law of the informant, was surrounded by nine persons named in the F.I.R. including the petitioners. At that time, son-in-law of the informant was assaulted by the accused persons through knife sustaining injury at his back, neck, chest and forehead. Learned counsel for the petitioner submits that, in fact,
Patna High Court Cr.Misc. No.5861 of 2017 (2) dt.20-03-2017 occurrence took place due to land dispute, in which, Shahid @ Shahid Alam (petitioner no. 1) and Mosim (petitioner no. 3) have sustained injury, regarding which, Amour P.S. Case No. 213 of 2015 is also instituted on the basis of written report of petitioner no. 3 against the informant, his son-in-law and others. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Amour P.S. Case No. 214 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
