JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 25-08-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.

Petitioner has approached this Court having participated in the process of selection for appointment to the post of Constable pursuant to Advertisement No.2 of the year 2009. It is submitted that in the first final result, her name figured in the list. In the second list which was published on 10.08.2011 pursuant to certain orders passed by this Court in the proceedings arising out of in C.W.J.C. No.14170 of 2010 and analogous cases, result was revised, whereafter the petitioner has been excluded. The orders passed in the writ proceeding referred to by the petitioner have never been assailed or challenged in appropriate proceeding.

The petitioner as per the averments made in the counter affidavit

Patna High Court CWJC No.8942 of 2013 dt.25-08-2018 2/2 was below the last recommended candidate in her category of Extremely Backward Class female Non Home Guard (EBC-F-NHG) category. The claim of the petitioner, therefore, for appointment cannot be sustained since none below her have been selected from the final result. The averments made in the counter affidavit have not been denied or disputed by filing rejoinder also. For the reasons indicated hereinabove, this writ petition is dismissed.
