The petitioner is accused in connection with Phulpras P.S. Case No. 243 of 2014, registered under Section 307, 384, 386/34 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is of firing at the informant by the petitioner and one Gautam Yadav for not giving the ransom by the informant.
Learned counsel for the petitioner submits that there is dispute over the fisheries of the petitioner with Devendra Mukhiya, who is close of the informant due to that reason, the petitioner has falsely been implicated in this case. Moreover, it would appear from the F.I.R. that nobody had sustained injury in
Patna High Court Cr.Misc. No.17874 of 2016 (2) dt.03-05-2016 2/2 the alleged firing of the petitioner and co-accused Gautam Yadav. The petitioner is accused in 11 cases, as detailed in para 3 of the petition, but in all cases, the petitioner is on bail. The petitioner is in custody since 23.01.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Jhanjharpur Madhubani in connection with Phulpras P.S. Case No. 243 of 2014. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner. (Rajendra Kumar Mishra, J) manish/- U T
