This is a petition for grant of anticipatory bail for offence under Sections 406, 467, 468, 420 and 34 of the Indian Penal Code and 7 of the Essential Commodities Act.
From a vehicle rice was allegedly seized which was said to be of the petitioner, who is a public distribution system dealer.
Submission of the petitioner is that the petitioner has got no criminal antecedent and has been falsely implicated in this case in spite of the fact that rice is not a controlled item and there is no tangible evidence that the recovered rice was from the public distribution system dealer's shop of the petitioner.
Considering the aforesaid fact, the petitioner, above named, in the event of her arrest or surrender,
Patna High Court Cr.Misc. No.8350 of 2017 (2) dt.09-03-2017 2/2 within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Araria P.S. Case No. 715 of 2016 to the satisfaction of the Chief Judicial Magistrate, Araria, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
