The petitioner seeks anticipatory bail in connection with Atri P.S. Case No.24 of 2015 registered for the offences punishable under sections 327 and 384 read with 34 of the Indian Penal Code.
It is contended that the entire allegations made in the FIR are malicious in nature. Though the beneficiaries have alleged that the petitioner took Rs.10,000/- from each of them on 20th January, 2014, a complaint in this regard was made before the Executive Magistrate after more than one year on 11.2.2015. Learned counsel for the State has opposed the prayer for bail.
Patna High Court Cr.Misc. No.12011 of 2015 (3) dt.30-07-2015 2/2 Regard being had to the inordinate and unexplained delay in institution of the complaint, in the event of arrest or surrender within a period of four weeks from today, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Atri P.S.Case No.24 of 2015 subject to the conditions as laid down under section 438(2) Cr.P.C.
