Petitioner seeks bail in a case registered under Sections 341, 323, 332, 333, 353, 307, 504, 506, 272, 273, 414 of Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Petitioner's counsel submits that the petitioner should also be allowed the privilege of bail on account of parity with co-accused Jitendra Sharma @ Jitendra Kumar Sharma who has been granted bail by a coordinate Bench of this Court by order dated 30.08.2019 passed in Cr Misc No 54076 of 2019. It is submitted that co-accused Jitendra Sharma @ Jitendra Kumar Sharma as well as petitioner have been implicated and arrested

Patna High Court CR. MISC. No.54627 of 2019(3) dt.30-09-2019 2/2 in this case in the same occurrence of recovery of liquor. Petitioner has no criminal antecedent and is in custody since 22.07.2019.

Having considered the submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II -cum- Special Excise Act, Madhubani in Deodha Police Station Case No 98 of 2019 dated 21.07.2019 with the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
