The petitioner has preferred this application for grant of regular bail in a case registered under sections 363, 366A, 379 and 34 of the Indian Penal Code to which section 8 of the POCSO Act was added subsequently.
As per the prosecution case, the minor daughter of the informant was kidnapped by the five named accused persons including the petitioner for the purpose of marriage. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case only for the reason of his proximity with coaccused Bhola. The daughter of the informant returned and her statement under section 164 Cr.P.C. was recorded wherein she has not

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, the contents of the statement of the daughter of the informant under section 164 Cr.P.C., the petitioner having remained in custody for 9 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Bagaha (Pathkhauli) P.S. Case no. 186 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran.
