2. The petitioner apprehends his arrest in connection with Shahpur P.S. Case No. 52 of 2025, instituted under Section 30(a) of the Bihar Prohibition & Excise Act.

3. There is recovery of 22 litre country made liquor from a lane opposite to the house of the petitioner. It is alleged that petitioner managed to flee away from the spot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to village politics and on the basis of suspicion. Nothing has been recovered from the conscious possession of the petitioner. Petitioner was not present on the spot. There is no independent witness to the occurrence. Petitioner has no concern with the seized liquor. Petitioner has one criminal antecedent in which he is

Patna High Court CR. MISC. No.55892 of 2025(2) dt.02-09-2025 2/2 on bail. He undertakes to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. 2, Bhojpur at Ara in connection with Shahpur P.S. Case No. 52 of 2025, subject to the conditions laid down in Section 482
