The petitioner is apprehending his arrest for the offences instituted under Sections 498A of the Indian Penal Code. The prosecution story, in brief, is that the petitioner being the husband of the victim alongwith others used to torture and assault her for non-fulfillment of dowry demand in the way of her father's house of Chapra Town. Her father gave him rupees three lakhs and after some period they again started putting pressure for the house of Chapra Town. Lastly they assaulted her, snatched her belongings and brought her to Chapra katcheri Rly. Station by train and left her there and fled away. The complaint has two daughters from the wedlock.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.52163 of 2014 (5) dt.03-09-2015 P2/2 petitioner has got no criminal antecedent. It is further submitted that there is no chance of reconciliation between the parties. It has further been submitted that the petitioner is ready to pay an amount of rupees four thousand per month in the court below which shall be released in favour of the complainant. On behalf of the State and counsel for the informant, it has been submitted that the petitioner is husband of the complainant and is named in the complaint petition.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of rupees four thousand per month in the court below which shall be released in favour of the complainant, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Complaint Case No. 2991 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
