JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 324, 326, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that on the order of petitioner no.1, coaccused Chintu Kumar opened fire on the informant but it did not cause any injury, thereafter, petitioner no.2 and co-accused Arjun Sharma brutally assaulted the informant with iron rod. It is submitted by learned counsel for the petitioners that the accusation of assault is not against petitioner no.1. The discharge summary report of the informant from Jawahar Lal Nehru Medical College Hospital, Bhagalpur has been brought on
Patna High Court Cr.Misc. No.12148 of 2015 (2) dt.25-03-2015 2/2 record by way of supplementary affidavit which suggests that the informant was diagnosed for gunshot injury on the left arm. There is counter version of the occurrence also.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bhagalpur in connection with Nath Nagar (Lalmatiya) P.S. Case No. 339 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
