2. Petitioner seeks regular bail in connection with Chandradip P.S. Case No. 69 of 2025 in a case registered for the offences punishable under Sections 103(1)/238/3(5) of the B.N.S., 2023.
3. As per prosecution story, it is alleged that during marriage function, scuffle took place between the deceased and other accused persons including the petitioner and in course of scuffle, the F.I.R. named accused persons brutally assaulted and killed the deceased.
4. Learned counsel for the petitioner submits that petitioner is innocent and falsely been implicated in this case. He further submits that the informant is not an eye witness of the occurrence. Only suspicion raised against this petitioner and
Patna High Court CR. MISC. No.56556 of 2025(4) dt.07-11-2025 2/2 others. Except suspicion, there is no other material to show the involvement of petitioner in the alleged occurrence. As per postmortem report, it appears that deceased had sustained only one injury. Petitioner has no criminal antecedent and he is in custody since 05.05.2025. Similarly situated co-accused person, namely Koushal Kumar had already been granted regular by a coordinate Bench of this Court vide order dated 15.10.2025 passed in Cr. Miscellaneous No. 50684 of 2025.
5. Learned counsel for the State and learned counsel for the informant vehemently opposes the prayer for bail.
6. Considering the facts and circumstances of the case and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of court of learned Additional Chief Judicial Magistrate, 1st, Jamui, in Chandradip P.S. Case No. 69 of 2025.
