The petitioners apprehend their arrest in connection with Deo P.S. Case No. 82 of 2018 registered under Sections 353, 427 and 440/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Aurangabad. The accusation is that in course of hearing a case related to land dispute between Narendra Kumar Singh and others versus Yogendra Choudhary and others, both parties quarreled to each other. In the meantime, petitioners dashed the informant, who is Circle Officer of Deo Anchal, and tried to tear
Patna High Court Cr.Misc. No.50036 of 2018(3) dt.20-09-2018 2/2 the papers related to the aforesaid case.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
