1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Shakurabad Police Station Case No. 103 of 2024, dated 02.06.2024, disclosing offences under Sections 147/149/341/323/307/504/506 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, as per the First Information Report, is that on 02.06.2024, at about 02:30 PM, a scuffle took place between the cousin brothers of the informant, namely, Madan Ram and Shyam Nandan Ram, on the point of drainage. The informant arrived there and saw that the petitioner, along with other accused persons, were abusing both the brothers and he tried to intervene in the
Patna High Court CR. MISC. No.55405 of 2025(2) dt.27-08-2025 2/3 matter, but all the accused persons, including the petitioner, started abusing and assaulting him. It has further been stated that when the informant informed the incident to the police, the accused persons abused and assaulted the informant. In the meanwhile, the petitioner came with country-made pistol and fired upon the informant, but the bullet did not hit him. Upon arrival of the police party, the petitioner and other accused persons assaulted the police personnel also, for which, a separate First Information Report has been lodged.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this present case due to dispute between the two cousin brothers of informant. He next submits that the dispute due to flow of drainage of water was going on between the two brothers of the same village, in which, the petitioner and others tired to pacify the matter, however, the informant, who is cousin brother of those two brothers, did not want to end the fight due to which the present altercation took place. He further submits that in the present case nobody has sustained fire-arm injury and during the course of
Patna High Court CR. MISC. No.55405 of 2025(2) dt.27-08-2025 3/3 investigation, no incriminating article and/or used cartridges have been recovered from the place of occurrence.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that nobody has sustained fire-arm injury, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Shakurabad Police Station Case No. 103 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
