JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khagaria (Muffasil) P.S. Case No. 206 of 2018 instituted for the offence under Sections 147, 148, 149, 341, 323, 307, 302, 448 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is alleged to be an order giver.
In the written report there is specific allegation of making firing against co-accused Anuj Yadav on brother of the informant namely, Rahul, on account of which, he died on the spot. The Specific allegation against co-accused Brajesh Yadav is that he fired on brother of the informant namely, Deepak Yadav, which hit on his right arm.
Counsel for the petitioner submits that there is case and counter case between the parties. The instant case is counter blast
Patna High Court Cr.Misc. No.49821 of 2018 (3) dt.01-10-2018 2/2 of Muffasil P.S. Case No. 207 of 2018 filed by the petitioner against the informant and others in which Bhavo of the petitioner has been murdered.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P.S.
