Mr.Ajit Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 366 of the Indian Penal Code.

As per the prosecution case, the informant suspects that her daughter has been kidnapped by some unknown miscreants for the purpose of marriage.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that the victim in her statement u/s 164 of the Cr. P. C. has specifically stated she was neither kidnapped by anybody nor any sexual assault was committed with her. In the medical examination the age of the victim has been found to be 19-21 years and no sign of sexual assault has been found on

Patna High Court CR. MISC. No.67899 of 2021(3) dt.21-04-2022 2/2 her person. Petitioner claims clean antecedent and is in custody since 18.09.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, the statement of victim recorded u/s 164 of the Cr. P. C. and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-I, Bagaha, West Champaran in connection with Ramnagar PS case No. 245/2021.
