JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(a), (f) of Excise Act. In huge quantity country made liquor is said to have been recovered from the house of the petitioner on 09.02.2016. Petitioner is in jail custody since 10.02.2016 and does not have any criminal antecedent. It appears that petitioner happens to be first offender and he has remained in jail custody for near about three months.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.18636 of 2016 (2) dt.03-05-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (T) Case No. 23(O) of 2016.
