JUSTICE SANJAY PRIYA ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint Case No. 1489 of 2016, Trial No. 1317 of 2016 instituted for the offence under Sections 420, 467, 468 and 120B of the Indian Penal Code.
As per complaint petition, the accused No. 1 executed sale deeds in favour of accused No. 2 to 6. The allegation against the petitioner is that he also played important role in execution of those sale deeds.
In such circumstances, there is no allegation of overt act against the petitioner. He is neither executant nor the beneficiaries of the sale deeds in question.
Patna High Court Cr.Misc. No.10036 of 2017 (2) dt.08-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Complaint Case No. 1489 of 2016, Trial No. 1317 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Gopalganj, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
