Petitioners seek bail in Laxmipur P.S. Case No.161 of 2018 registered for the offences under Section 366(A) of the I.P.C. Allegation against the petitioners is of kidnapping the minor daughter of the informant.
Submission of the learned counsel for the petitioners is that victim girl has been recovered from the Bus Stoppage. There is no specific allegation against the petitioners. Heard learned A.P.P. also who opposed the prayer for bail of the petitioners stating that the victim girl in her statement recorded under Section 164 Cr.P.C. has supported the prosecution case and has named these petitioners.
Patna High Court Cr.Misc. No.47409 of 2018 (3) dt.20-09-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, at this stage, I am not inclined to grant bail to the petitioners. The prayer for bail of the petitioner is rejected.
However, once charge is framed in this case and the trail commenced, the learned Sessions Judge shall release the petitioners on bail to his own satisfaction.
This application is disposed of.
