2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 302, 307, 120B/34 of the Indian Penal Code and section 27 of the Arms Act.
3. As per prosecution case, co-accused Gauri Shankar Maharaj @ Kishan Jha and Neeraj Pathak fired shots on the deceased, whereas co-accused Babasaheb Jha fled away from the scene of alleged occurrence. Gauri Shankar Maharaj was apprehended by the villagers and was beaten to death, while Neeraj Pathak was handed over to the police.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-
Patna High Court CR. MISC. No.57885 of 2025(3) dt.04-11-2025 2/2 accused. Co-accused, with similar allegation, have already been allowed pre-arrest bail by a co-ordinate bench of this Court vide paragraph 17 of the bail petition. Petitioner is in custody since 25.2.2025.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the nature of accusation and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Sheohar in Purnahiya Police Station Case No. 150 of 2020.
