JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 The petitioner is languishing in custody since 07.01.2015 in connection with Nawada Mufassil P.S. Case No. 07 of 2015 for the offences instituted under Sections 376/511 of the Indian Penal Code and Section 7 of the POCSO Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 06.01.2015 at around 11 P.M., when the informant was sleeping alone in her room next to the room of her maternal grand-mother and grandfather, she felt a person sleeping next to her due to which she woke up and the person started to assault her physically and sexually. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. Further it has been submitted that the petitioner has no criminal antecedent and the petitioner is in custody since 07.01.2015. Further it has been brought to the notice of this Court Annexure-2 by which a compromise has been entered between the parties. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada, in connection with Mufassil P.S.
