The Petitioners seek regular bail in connection with Sessions Trial No. 405 of 2018 arising out of Naugachhia P.S.Case No. 247 of 2017, registered for offences punishable under Sections 326 and 302/34 of the Indian Penal Code. Allegation as per F.I.R. against the petitioners is that they allegedly burnt to death of the father and son of the informant.
Submission of the learned counsel for the petitioners is that except suspicion, there is no evidence against the petitioners and there is no any cogent material available against the petitioner to connect the offence and the petitioners are in custody since 17.01.2018 and 23.01.2018, respectively. It is also submitted that the similarly situated co-accused person has been granted bail by a Co-ordinate Bench of this Court vide order dated
Patna High Court Cr.Misc. No.49235 of 2018 (3) dt.01-10-2018 2/2 18.06.2018 passed in Cr. Misc. No. 5753 of 2018. Heard learned A.P.P also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional District Judge, Naugachhiya, Bhagalpur in connection with Naugachhia P.S.Case No. 247 of 2017, Sessions Trial No. 405 of 2018, subject to the following conditions:- i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
ii) The petitioners will not induce any witness or tamper with the evidence.
iii) Petitioners shall co-operate in disposal of trial and be present in Court, as and when required by Trial Court, except showing genuine reasons, otherwise, their bail bonds shall be cancelled. (Vinod Kumar Sinha, J) Sudha/- U T
