JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-02-2017 Heard Ms. Sinha in support of the present application and Mr. Nirmal Kumar Sinha APP for the State. This is repeat application seeking anticipatory bail. A prayer for bail made on his behalf along with others was considered and declined by the Court on 13.04.2016. He was required to surrender and seek regular bail.

It is stated that the petitioner is a juvenile. This fact was not brought to the notice of the Court. However, on perusal of the statement made in the anticipatory bail petition (Cr. Misc. no. 12990 of 2016) the Court finds that no such statement was made in the bail petition.

Considering the aforesaid as also the relevant facts appearing from the records, I am not persuaded to extend him the privilege of anticipatory bail. It will be open to the petitioner to
