The petitioner apprehends her arrest in connection with Begusarai Town P.S. Case No.452 of 2016 registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code. The accusation is that the police received information about conducting of the examination for the selection of Panchayat Coordinator and Block Coordinator under the Pradhanmantri Kaushal Vikas Yojana in the rented house of Ashok Singh named as "Kiran Sadan". Thereafter, the police reached there and found some students giving the examination. Two persons were found in the office, who disclosed their name as Gopal Kumar Jha and
Patna High Court Cr.Misc. No.14088 of 2017 (3) dt.06-07-2017 2/3 Animesh Kumar. Gopal Kumar Jha disclosed that he is the Coordinator of the Examination and Animesh Kumar Jha was found engaged in keeping the documents at the office. On query, Gopal Kumar Jha disclosed that this petitioner is the Secretary of the N.G.O. and she is engaged in conducting the said examination and her brother used to do her work. On query made by some examinees, they disclosed that they had come for giving the examination after applying for selection on such post and depositing Rs.200/- as examination fee.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the seizure list, annexed with the F.I.R., that the documents which have been received from the office relate to the Trust named as "Bharat Sasaktikaran Trust" on which the name of the Director is printed as Sanjay Kumar. In fact, the petitioner was running the N.G.O. in the name of "Madhyam" for training and skill development taking the said house on rent and as it was not successful, she left the said house and, thereafter, the said house was taken by Gopal Kumar Jha on rent, who was engaged in "Bharat Sasaktikaran Trust". The petitioner has no concern with that Trust.
On the other hand, while the learned A.P.P. for the State opposed the prayer of the petitioner for grant of anticipatory bail
Patna High Court Cr.Misc. No.14088 of 2017 (3) dt.06-07-2017 3/3 but submits that the case diary, which is upto paragraph-20, shows that Gopal Kumar Jha was the Secretary of "Bharat Sasaktikaran Trust" and there is nothing against the petitioner in the case diary showing her involvement.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No.452 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
