Petitioner seeks bail in Bettiah Muffasil (Banuchhapar) P.S.Case No.99 of 2018 registered for the offences under Sections 399 and 402 of the I.P.C. and Sections 25(1-b) (a), 26, 35 of the Arms Act.

Allegation against the petitioner is of recovery of one country made loaded pistol from his possession. He is accused in one more case also.

Submission of the learned counsel for the petitioner is that he has remained in custody for six months and he undertakes to abide by the conditions as is imposed by the Hon'ble Court. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.47623 of 2018 (5) dt.20-09-2018 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., West Champaran at Bettiah, in Bettiah Muffasil (Banuchhapar) P.S. Case No.99 of 2018 subject to the condition that one of the bailors must be family member of the petitioner who will undertake that the petitioner will not indulge in such type of nefarious activity in future.
