The petitioners are apprehending their arrest in connection with Sheohar P.S. Case No. 222 of 2016 for the offences instituted under Sections 304(B)/34 of the IPC. The prosecution story, in brief, is that the informant's sister was married to one Ajit Kumar @ Sapan Kumar in April, 2016. After marriage, Ajit Kumar started demanding motorcycle as dowry. On 24.12.2016, he informed the informant that his sister had died. The informant alongwith others went at his sister's in-laws house and came to know that his sister was not ill but no body was saying that how she died. So, he has suspected that Ajit
Patna High Court Cr.Misc. No.5718 of 2017 (3) dt.03-03-2017 2/2 Kumar and the petitioners have murdered his sister. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. Petitioner no. 1 is the father-in-law and petitioner no. 2 is the mother-in-law of the deceased. They are separate in mess and property from the husband of the deceased. From perusal of the postmortem report, it is evident that the cause of death is due to sudden cardiac arrest leading to cardiac respiratory failure. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Sheohar P.S. Case No. 222/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheohar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
