The petitioner apprehends his arrest in a case registered for the offence under Section 272, 273 of the I.P.C. and Section 30(a), 38(i), 41(i) of Bihar Prohibition and Excise Act.

Total 5544 liters foreign liquor has been recovered from a truck.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the said truck and nothing has been recovered from his conscious possession.

However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got two criminal antecedent of similar nature.
