By way of filing an application under Section 438 of the Code of Criminal Procedure, the petitioners seek anticipatory bail in connection with Madhepura P.S. Case No. 224 of 2014 registered for the offences punishable under Sections 406, 467, 468, 469, 471 and 420 read with 34 of the Indian Penal Code.

It is contended that the allegations made in the FIR

Patna High Court Cr.Misc. No.12913 of 2015 (5) dt.26-08-2015 2 / 2 would make out a dispute of civil nature. However, with an ulterior motive, the present FIR has been instituted on 15.04.2014 levelling totally false and concocted allegations. Moreover, the petitioner has already paid Rs. 22,00,000/- to the informant which was accepted by him while entering into an agreement for sale.

Learned counsel for the State has opposed the prayer for bail.

Regard being had to the nature of the offence and the defence taken by the petitioners, in the event of arrest or surrender before the court below within six weeks from today, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 224 of 2014 subject to the condition as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
