The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420, 323, 379, 504/34 of the Indian Penal Code. It is alleged that in a sale deed with regard to purchased land of the complainant, the name of accused persons were wrongly shown as boundary 'raiyati' as a result the petitioners executed the sale deed of the part of the land of the complainant and when the complainant made protest for not allowing him to construct boundary wall he was assaulted.

No.15033 of 2015 (2) dt.12-05-2015 2/2 It is submitted by learned counsel for the petitioners that in the background of bona fide land dispute the accusation has been levelled and title suit is pending between the parties when co-accused Md. Daulat @ Aasin Mohiuddin has been granted anticipatory bail vide Criminal Miscellaneous No. 49025 of 2014.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhepura in connection with Complaint Case No.70 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
