2. Learned counsel for the petitioners and learned APP for the State are present.
3. Learned counsel for the petitioners submits that the petitioners have preferred the present criminal miscellaneous application with a prayer for grant of anticipatory bail and vide order dated 20.09.2023, the petitioners were granted anticipatory bail, but in the order sheet, the proforma for regular bail has been typed in place of anticipatory bail. As such, he submits that necessary corrections may be made in paragraphs
Patna High Court CR. MISC. No.58454 of 2023(3) dt.06-10-2023 2/3 nos.2 and 6 of the order dated 20.09.2023.
4. Learned counsel for the State also agrees on the submissions made by learned counsel for the petitioners.
5. Upon perusal of the record, it transpires to this Court that the contention of the petitioners is correct. As such, paragraph no.2 of the order dated 20.09.2023 shall be read as follows:- "2. The petitioners are apprehending their arrest in connection with Narayanpur P.S. Case No. 51 of 2023 registered on 20.05.2023 for the offences punishable under Sections 304B/34 of the Indian Penal Code."
6. Similarly, the necessary changes in paragraph no.6 of the order shall be read as follows: - "6. In the facts and circumstances, let the abovenamed petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of 30000/- (thirty ₹ thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, VI, Bhojpur, Ara in connection with Narayanpur P.S. Case No.51 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. The order dated 20.09.2023 is modified to the extent as indicated above and the order passed today shall be treated as part and parcel of the order dated 20.09.2023. (Dr. Anshuman, J) Ashwini/- U T
