The petitioners apprehend their arrest in Bidupur P.S. case No. 514 of 2015 under Sections 304B, 201/34 of the Indian Penal Code.
The informant alleged that his daughter, Mamta Devi, was married with Anil Rai three years ago but her husband and other in-laws killed her and disposed of her dead body. The learned counsel for the petitioners submits that petitioners are maternal uncle and brothers of the husband of deceased and, of course, they are named in the FIR but they have no manner of concern with the family affairs of the deceased and
Patna High Court Cr.Misc. No.18601 of 2016 (3) dt.15-07-2016 2/2 her husband. No specific allegation is made against the petitioners. Considering the facts aforesaid and the fact that petitioners are maternal uncle and brothers of husband of deceased, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Bidupur P.S. Case No. 514 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
