The petitioner is languishing in jail since 1.10.2015 in a case registered for the offence punishable under sections 489C of the Indian Penal Code and sections 22, 23 of the N.D.P.S.Act. On secret information that the petitioner kept narcotic substance, a raid was led. From the house of the petitioner 600 grams of Ganja was recovered. A huge quantity of currency notes totaling Rs. 27,88.090/- were also recovered, out of which 4 pieces of 500/- denomination and three pieces of 1000/- denomination were found counterfeit.
It is submitted by the learned counsel for the petitioner that recovery was made from the joint family house of the petitioner. It is also submitted that the currency notes were of the
Patna High Court Cr.Misc. No.21766 of 2016 (3) dt.21-06-2016 uncle of the wife of the petitioner. More over, accusation of section 489C of the Indian Penal Code is bailable in nature and the recovery of Ganja was of small quantity.
Considering the aforesaid facts, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, N.D.P.S., Hajipur at Vaishali in Hajipur Sadar P.S.Case No. 491/2015, G.R.No. 4995/2015.
