JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

This Criminal Miscellaneous application has been filed for modification of the order dated 30.01.2017 passed in Cr. Misc. No. 867 of 2017 for extending the time by one month for depositing the 20% amount of alleged amount of Rs. 6,49,942.94 paisa.

In the facts and circumstances stated above, the petitioner is directed to deposit 20 % amount of Rs. 6,49,942.94/- within one month from today through bank draft in the account of F.C.I. Banmankh, Purnea. In mean time the petitioner in the event of his arrest or surrender shall be released on provisional bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Nagar P.S. Case

Patna High Court Cr.Misc. No.15484 of 2017 (2) dt.19-04-2017 No. 264 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. and after deposit of 20 % amount of the said amount the petitioner will file certificate accordingly in the learned court below and then the provisional bail granted to the petitioner shall be confirmed by the learned court below itself, failing which the bail granted shall be deemed to be cancelled. In the result, the order dated 30.01.2017 passed in Cr. Misc. No. 867 of 2017 is modified to the extent indicated above and this application is hereby allowed.
