JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2018 The petitioner is in custody since 11.01.2018 in connection with Navkothi P.S. Case No. 117 of 2017, registered for offences punishable under Sections 141, 148, 149, 341, 342, 302, 120(B) of the Indian Penal Code, 27 of the Arms Act and 3 and 4 of Explosive Substance Act.

Allegation as per F.I.R. is that one Aklu Singh and Bambam Singh have fired on the deceased and 10 other accused persons including the petitioner that they assaulted with rod upon his head and ladies accused persons have assaulted by stone on head.

Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and 10 other accused persons of assault on head and only two injuries

Patna High Court Cr.Misc. No.45920 of 2018 (4) dt.12-09-2018 2/3 were found on the head caused by hard and blunt substance and other is of firearm injury or on the other part of the body and the petitioner is in custody since 11.01.2018.

Heard learned A.P.P. as well as learned counsel for the informant, who has opposed the prayer on the ground that several injuries were found on the person of the deceased. Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000, (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Rghubir Prasad, Judicial Magistrate, 1st Class, Begusarai, in connection with Navkothi P.S. Case No. 117 of 2017, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates

Patna High Court Cr.Misc. No.45920 of 2018 (4) dt.12-09-2018 3/3 without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
