JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 376,313,428 and 354/34 of the Indian Penal Code.
It is alleged that the informant developed intimacy with the petitioner and got pregnant but subsequently the pregnancy was terminated by administering some medicine by the petitioner.
It is submitted by learned counsel for the petitioner this is not in dispute that the informant was major and established physical relationship of her own and there is nothing on record to suggest about the termination of pregnancy.
Patna High Court Cr.Misc. No.14626 of 2015 (2) dt.11-05-2015 2/2 This court finds substance in the submission of learned counsel for the petitioner, however, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Kishanganj P.S. Case No. 609 of 2014 pending in the court of learned C.J.M., Kishanganj.
This application is disposed of with the aforesaid observation/direction.
