JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Harnaut P.S. Case No. 299 of 2015, registered under Section 120(B) and 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that Police went in village Panchasil Nagar for inquiry of U.D. Case No. 05 of 2015, where he found a house was locked from the outside and on breaking the door of the said house, in presence of the witnesses, the dead body of Santosh Kumar Paswan was found hanging in the rented house of Bhola Kumar. It also come in the knowledge that there was illicit relationship between wife of the petitioner, Urmila

Patna High Court Cr.Misc. No.19302 of 2016 (2) dt.05-05-2016 2/2 Devi and Santosh Kumar Paswan (deceased) due to that reason, he has been killed by pressing the neck and only to conceal the evidence, his dead body was hanged on the ceiling fan. Except the suspicion having hand of this petitioner in the murder of Santosh Kumar Paswan due to illicit relationship with the wife of the petitioner, there is nothing to show the involvement of the petitioner in the present case. The petitioner has no criminal antecedent is in custody since 23.01.2016 and after the investigation, Chargesheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P.S. Case No. 299 of 2015.
