The petitioner seeks bail in a case registered under Sections- 147, 148, 149, 302, 307, 323, 354, 504, 452 of the Indian Penal Code and 27 of the Arms Act.

The allegation against the petitioner is of causing fire arm injury to Ravi Kumar.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22-03-2018 and there is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has already been submitted in this case. The main allegation is against co-accused Rajeshwar Singh who is said to have

Patna High Court Cr.Misc. No.48144 of 2018 (3) dt.13-09-2018 assaulted the deceased. The petitioner is said to have caused injury upon Ravi Kumar. The nature of injury is simple. No offence u/S 307 of the Indian Penal Code is made out. The other similarly situated co-accused namely, Subash Singh @ Subhash Singh has been granted bail by a coordinae bench of this court vide order dated 20-08-2018 passed in Cr. Misc. No. 41343 of 2018. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Tiwary, learned Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Kargahar P.S. Case No. 100 of 2018. (Sudhir Singh, J) A.K.V./- U T
