The petitioner seeks bail in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 40 litres liquor was seized. Petitioner is in judicial custody since 30.07.2019.

Considering the fact that the petitioner has no criminal antecedent and having 40 litres liquor was seized, the Court is inclined to grant bail to the petitioner subject to cash deposit of Rs. 15,000/- (fifteen thousand) in the Court below and on

Patna High Court CR. MISC. No.55440 of 2019(2) dt.02-09-2019 2/2 deposit of the same, the court below shall release the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Saraiya Police Station Case No. 274 of 2019.

The cash deposit of Rs. 15,000/- shall abide by the final outcome of the pending criminal case.
