JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 379 and 402 of the Indian Penal Code and 25(1-B)A/26/35 of Arms Act.

One country made loaded pistol was recovered from the conscious possession of the petitioner while he was making preparation for committing dacoity along with some accused but they were caught by the Police. However, the petitioner is in jail custody since 31.12.2015 and the co-accused, having more or less similar allegations, has been granted privilege of bail by this Court.

Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten

Patna High Court Cr.Misc. No.18840 of 2016 (2) dt.03-05-2016 2/2 thousand) with two sureties of the like amount each in connection with Alamganj Police Station Case No. 372 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City.
