JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2025 Heard learned counsel appearing on behalf of the petitioner, learned A.P.P. appearing on behalf of the State and learned counsel appearing on behalf of the informant/Opposite Party No. 2.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406, 420 and 379 of the Indian Penal Code and Section 66 of the I.T. Act.
3. As per prosecution case, it is alleged that when the informant went to withdraw cash from S.B.I. ATM, in the meantime, this petitioner saw her A.T.M. pin and later, withdrew Rs. 40,000/- from her bank account.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, the alleged money was accidentally transferred in the account of this petitioner and after knowing the facts, petitioner returned the alleged money in the account of informant and a compromise petition to that effect has also been filed by the parties before the learned trial court (copy of which is Annexure-P/2 to this application). Petitioner claims clean antecedents.
5. Learned counsel for the informant/Opposite Party No. 2 does not dispute the contentions raised on behalf of the petitioner and confirms the fact regarding compromise between the parties.
6. Considering the aforesaid facts and circumstances of the case and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Motihari Town P.S. Case No. 250
