JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Phulwarisharif P.S. Case No. 533/2019, disclosing offences under Sections 3147, 148, 149, 323, 307, 386, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner and others accused persons is of trying to kidnap the informant and also of making firing. It appears that petitioner is accused in one more case under Explosive Substance Act.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case at the instance of the police as mother of the petitioner had earlier filed a complaint against the police personnel and further there is no allegation of firing against the petitioner.

Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
