The petitioners are apprehending their arrest in connection with Sugauli P.S. Case No. 27 of 2015, G.R. No. 471 of 2015, registered for the offences punishable under Sections 323, 324, 307 and 506/34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that though there is allegation of assault to grandson of the informant against the petitioner but there is no injury available on record to show that injury is grievous in nature.
Heard learned APP also.
Having heard both sides and considering the
Patna High Court Cr.Misc. No.16595 of 2017 (2) dt.10-04-2017 2/2 allegation made in the FIR, I am not inclined to grant anticipatory bail to the petitioner. Let petitioner surrender and pray for regular bail, which shall be considered taking into account the materials available on record, including injury report of grandson of the informant and after considering the nature of injury, the court below will pass appropriate order, without being prejudiced by this order.
This application is dismissed.
