This application has been filed in connection with Chautham P.S.Case No.173 of 2016, G.R.No.2645 of 2016 for the offence under Sections 420/409 of the Indian Penal Code. Argument of the learned counsel for the petitioner is that he has been entrusted three construction works and so far two works are concerned, he has already completed and informed the authority concerned. So far third work is concerned, it has been submitted that he has not been given full amount rather he has been given amount only for those works, he has completed, as such there is nothing in this case against the petitioner. Heard learned A.P.P. also.

Having heard both sides. In view of the submission of the learned counsel for the petitioner, let the petitioner surrender

Patna High Court Cr.Misc. No.7568 of 2017 (2) dt.23-02-2017 2/2 before the learned court below, who will release the petitioner on provisional bail to his satisfaction and in the meantime, the petitioner will supply all the documents to the Investigating Officer of the case, who will examine the matter and if any materials come in the charge-sheet, the prosecution is free to move for cancellation of the bail bond of the petitioner and if he satisfied with the conduct of the petitioner, the court below will confirm the bail bond of the petitioner.
