Petitioner apprehends her arrest in connection with Baikunthpur P.S. Case No. 227 of 2014 registered for the offences punishable under Sections 304 B 201/34 of the Indian Penal Code. Petitioner happens to be Gotni of the deceased and submission on behalf of the petitioner is that she is separate from the husband of the deceased, which is evident from perusal of Annexure-3 to this petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that the allegation of illegal demand is against husband of the deceased, let petitioner, in the event of her arrest/surrender within
Patna High Court Cr.Misc. No.12566 of 2015 (2) dt.15-05-2015 2/2 four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class Gopalganj in Baikunthpur P.S. Case No. 227 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Namita/- U T
